If you've had your home repossessed or are staring down that particularly miserable barrel, you'll probably know there are plenty of sources of information and support but nowhere to have a damn good rant about it.

Psychologists say "to share is to relieve." As we know only too well, getting it off your chest can be really therapeutic. So here it is!!

This site is for the sole purpose of telling your story, the story the courts and the system as a whole are not interested in: what happened? what went wrong? Your experiences could help someone else find a way out!

It has just been discovered that owing to a problem with Terry's email server, a large number of emails that have been sent in since December by visitors to this site and by viewers of 'The Repo Show', have not been delivered to Terry's personal email account.

Unfortunately, these emails have been completely lost from the system and so Terry will not be able to see them nor reply to them. If you were one of those who sent an email expecting a reply, Terry sincerely apologises for not replying but it was out of his control.

50% increase in repossessions 2009

When our family home was repossessed last year I started the website www.the-repossessed.com to help people who found themselves to be in a similar situation as ourselves which now is visited on average by 20,000 people each day. The Armstrongs were the first family in the UK to repossess our own home and squat in it over Christmas which earned me the title of ‘The Repo Man’ and attracted media attention as reported on the above website.  The figures today as reported by the Council of Mortgage Lenders that repossessions for the first 3 months of this year are up by 50% on last year would explain the popularity of the repossessed website.

A brief summery of last weeks eviction

We received the eviction warrant in the post on Friday 23rd Jan which only gave us just 3 days including the weekend, to make the necessary arrangements for eviction at 9.00am on the 26th. Whatever the rules are regarding eviction warrants that’s wholly inadequate time to make arrangements. The situation created by Kingsford’s is deserving of close scrutiny. Kingsford’s should state plainly what their reasons are for seeking eviction at this time.

 

At the conclusion of the case Vale v Armstrong, Kingsford’s’ client received an out of court settlement from the Halifax of c£60,000 and Legal Aid paid Kingsford’s for their work in representing both their client and the Halifax Plc at the trial. Kingsford’s was granted a Consent Order by the court which stated we would surrender the property to them after a period of time, this time was allowed by the judge after representations were made by our legal team regarding our professional negligence claim against Thomson Snell & Passmore. The judge accepted the assertion that this claim should realise more than sufficient sums to cover Kingsford’s bill. Unfortunately our legal team’s oversight regarding a reimbursement we had to make to the Legal Aid Board ultimately resulted in the funds we received after successfully establishing TS&P’s negligence, being only about half of what was due, Kingsford’s only getting c£60k which left a balance of c£45k which has since increased to c£55k because of further costs and interest charges. This costs bill we are currently dealing with is Kingsford’s’ ‘Top Up’ fees over and above the payments received from Legal Aid which totalled in excess of c£100k.

 

Kingsford’s’ eviction action does not make economic sense in terms of recovering the balance of the legal costs outstanding given the Consent Order in place demands the property cannot be sold for less than £550.000 and as Kingsford’s’ charge is 4th in line behind Northern Rock, SPPL (part of Lehman Brothers) and the unsecured Morgan Stanley credit card debt which was later secured on the property. The total debt amounts to c£531.500 between them, less 50% of the equity which is due to Mrs Armstrong, Kingsford’s would stand to get very little even if they could sell the property for the £550,000 stated on the Consent Order which is completely unrealistic under the present financial constraints and the collapse of the housing market. Our best estimate of the current value of the property is around £400,000. There is no sound economic reason to make a family of four homeless when there is no hope of selling the house for any amount capable of achieving a successful financial conclusion to the Order of Sale in Kingsford’s’ possession. It would have been preferable for all concerned were we permitted to stay whilst attempts are made to settle the debt or at least until the market improves and a better price can be achieved capable of clearing more of the debts.

Window of opportunity!

Terry was evicted for £55k by Kingsfords solicitors representing the remaining unpaid costs in the case Vale -v- Armstrong. The day after the eviction Kingsfords e-mailed Terry’s solicitors, regarding arrangements to remove his stuff and the last paragraph of which reads.

WITHOUT PREJUDICE
No doubt your client knows that if he pays my client the money due to him

On the 22nd January 2009 we recieved a letter from Senior Manager Scott Taviner at Northern Rock acknowledging my request dated 20th November to come to some agreement to accept affordable mortgage payments. Please note Mr Taviner’s letter was dated the 16th January 2009 but it didnt arrive in the post until the 22nd January this being the same day that Kingsfords of Ashford, Kent  solicitors for the alledged peadophile issued the attached notice of eviction we recieved by post today (23rd Jan).

Coincidence - more like collusion!

Its been obvious to us all along that Northern Rock ellected to use Kingsfords to do their dirty work.

TERRY DOES DUNDAS & DUCE

HOT OFF THE PRESS
There have been developments regarding “Uncle Arry” which puts a whole new dimension on the case if confirmed. In support of Terry’s current position he has received unsubstantiated reports indicating Uncle Arry’s peado ring have been active and all that is required is for the victims or their parents to come forward and bear witness which they are urged to do to protect other children.
This news came to light when Terry reported on the repossessed website he had taken legal action against the Kent firm of solicitors Dundas & Duce who were employed to give Uncle Arry independent legal advice with regard to the conveyance of his house to the Armstrongs. See the short film Uncle Arry on the left side of this page. The presiding Judge in the trial Vale -v- Armstrong Mr Justice Evans Loombe heavily criticised Mr Duce in his summing up of the case HC03C00770 for failing in his duty of care to both Mr Vale and Mr Armstrong pointing out that had Mr Duce executed his duties according to law the matter of Vale -v- Armstrong would never have arisen.

Having no trust in the legal system Terry is a litigant in person against Dundas and Duce but would welcome any advice from those with experience of such matters.

A little Christmas cheer!

Yesterday I wrote an Open Letter to Ron Sandler, the Executive Chairman of Norther Rock asking for them to spread a little Christmas cheer over the festive season.  When my house lays empty for Christmas, haven’t Northern Rock the heart to let us stay there at least to watch the Queen’s speech?

Rock and a Hard Place

Northern Rock denies it’s aggressively taking back the homes of those in mortgage arrears and the government denies any day-to-day input.  It’s the only fully nationalised bank. So should Northern Rock be repossessing homes at a faster rate than some other lenders?   The bank’s chairman, Ron Sandler, said it was operating the same policy as it did before it was nationalised.   And Gordon Brown insists the bank is run “at arms length” from the government.  But some homeowners believe the Rock is taking a tough new line.
